Rockynats Ticketing Terms and Conditions and Conditions of Entry

This ticket is sold on behalf of Rockhampton Regional Council (“Council”) and Rockynats Pty Ltd (“Event Organisers”) who are together responsible for delivery of the Rockynats (“Event”).

By purchasing tickets to the Event, you agree to the Ticketing Terms and Conditions:

Ticket Terms

  1. All tickets are non-refundable and non-exchangeable except in accordance with the applicable laws in the region of purchase.
  2. Children 12 years and under receive free general admission access with a general admission paying adult. Children 12 years and under must be accompanied by a responsible adult at all times whilst inside the Event precincts. Maximum of six (6) free children’s tickets per one (1) adult general admission ticket. Free children’s tickets must be selected during the ticket purchase process. The free children’s tickets do not provide access to the Platinum Grandstands.
  3. Event Organisers reserve the right to withdraw, reschedule or substitute shows and may vary advertised programs, prices and venues.

Ticket Requirements

  1. Ticket must be presented on arrival at the entry Tickets can be printed or displayed via mobile phone.
  2. Ticket to be redeemed at Event for wristband or lanyard in order to gain entry and re-entry. Wristband/lanyard must be worn for the whole Event duration. Broken or lost wristbands/lanyards will not be honored.
  3. Entry may be refused if tickets, wristband or lanyard are damaged or defaced in any way or are not purchased through an authorised point of sale.
  4. In the event that a duplicate copy of any e-ticket appears, the Event Organisers reserve the right to request proof of identity and proof of purchase. Unauthorised duplicate ticket holders will be refused entry to the Event.
  5. The right of admission is reserved and is subject to the Event Conditions of Entry (‘Conditions of Entry’).

Conditions of Entry

By attending the Event you agree to the following Conditions of Entry:

  1. Conditions of Entry include the right for the Event Organisers to inspect and search bags on entry to the Event site.
  2. You must ensure that you and your invitees act in an orderly manner when attending the Event. The Event Organisers may refuse entry or evict you or any of your invitees if you or your invitees behave in a disorderly, offensive or inappropriate manner.
  3. You must not enter any restricted areas, such as back of house, competition and performance areas, VIP and hospitality areas or any other area not accessible by the public;
  4. No alcohol or illicit drugs are to be brought into the Event
  5. Alcoholic beverages must not be taken into or out of the Event. It is an offence for minors to purchase or consume alcohol or for persons to supply alcohol to minors. Alcohol may only be consumed in clearly marked areas of the Event site;
  6. No video cameras or professional cameras are permitted on the Event Audio or visual recordings of the Event are prohibited. Still cameras (not professional) are permitted but images may only be used for private purposes and not public display. Any images and footage taken at the Event must not be used for commercial purposes.
  7. Patrons are only permitted to bring small amounts of food for personal consumption and sealed bottles of water into the Event. Consideration will be given to those with special dietary requirements;
  8. Smoking (including the use of electronic cigarettes or similar devices) is only permitted in the designated outdoor smoking areas of the Event site;
  9. Unauthorised soliciting, collections and customer surveying is not permitted;
  10. You must not engage in any form of ambush marketing and must not conduct any activity that conflicts with, impairs, infringes or denigrates the rights of any official sponsor or Event Organiser.
  11. No drones or remotely piloted aircraft are permitted on the Event site.
  12. All vehicles must adhere to onsite speed limits and Traffic Management Plans.
  13. You must follow all reasonable directions given by the Event Organisers and the Event Organisers’ employees, personnel and contractors, including security. Any person who fails to comply to the reasonable instructions of the Event Organisers and the Event Organisers’ employees, personnel and contractors, including security, will be treated as breaching the Conditions of Entry and will be evicted or remove from the Event.
  14. You must not behave in a threatening or inappropriate manner (aggressive, riotous, abusive, or insulting actions) towards other patrons or Event staff. Anyone found engaging in such behavior, will be evicted from the Event and may be refused re-entry to the Event.

Prohibited Items

  1. You agree and understand that the listed items below are prohibited items and are not permitted at the Event:
    1. Shade structures
    2. Glass and Glass bottles
    3. Illegal substances, including controlled, dangerous or illicit drugs
    4. Flares or fireworks, explosives or any fire twirling equipment
    5. Laser pointers
    6. Weapons, or resemblance of weapons, including knives, firearms, blunt offensive objects, batons and those with sharp ends
    7. Projectile items, including balls, frisbees, rackets or similar objects
    8. Bicycles, skateboards, skates, scooters and helmets of any form
    9. Political or offensive materials including protest paraphernalia and banners
    10. Recording devices (for commercial purposes) and tripods
    11. Selfie sticks
    12. Flag poles of more than 1 metre in length / banners or flags larger than 1m x 2m
  2. Eskies and bags of larger dimensions than 35cm in height, 20cm in width and 30cm in length (i.e. too large to be stored under a seat), including motorized eskies
    1. Domestic animals (other than trained assistance dogs)
    2. Musical instruments and noise makers, including drums, air horns and loud hailers
    3. Other items as determined by Council that may cause injury, public nuisance or safety concerns
  3. Breaches of any of the above Conditions of Entry may result in your removal from the Event. The Event Organisers’ reserve the right to refuse entry to the Event to any patron who:
    1. Does not have valid event accreditation (Event Ticket, Event wristband or lanyard)
    2. Is in possession of any prohibited or illegal items
    3. Does not adhere to the Conditions of Entry, T&Cs and/or the Event Organisers’ reasonable directions at all times.

Refunds, Cancellations and Changes

  1. The Event Organisers reserve the right to cancel or postpone the Event for any reason.
  2. If the Event, or any part of the Event, is cancelled due to adverse weather or for any other cause reasonably beyond the Event Organisers’ control, there is no right to refund or exchange and no obligation is assumed by the Event Organisers to arrange a substitute Event.
  3. You consent to be included in photographs, film and sound recordings of the Event and for these photographs and recordings to be used by Council during or after the Event, including for promotional purposes.
  4. To the fullest extent permitted by law, the Event Organisers do not accept liability of any nature for the acts, omissions or default of those providing services in connection with the Event or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with this Event. Where legislation implies any condition or warranty which cannot be excluded or modified, that condition or warranty will be deemed to be included in these conditions. However, the Event Organisers’ liability for any breach of such condition or warranty will be limited, to the cost of refunding the ticket. In no event will the Event Organisers be liable for any indirect, consequential, exemplary or special damages.
  5. You acknowledge that the Event Organisers will not be responsible for any loss or damage to any property (including personal property such as bags, money or other personal items) brought to or purchased at the Event by you or your invitees.
  6. You are solely liable for any loss or damage suffered or caused by you or your invitees at the Event.
  7. There will be no refund on any unused portion of tickets if you or your invitees are asked or forced to leave or if you decide not to attend any part of the Event.
  8. Pursuant to your booking, the Event Organisers may need to collect and keep personal information about you including your name, address, payment details, telephone number and the names of all ticket allocations.
  9. The Event Organisers may need to disclose your personal information as required by law or as permitted under the Information Privacy Act 2009 (Qld). Council’s Privacy Policy outlines how the Event Organisers will handle your personal information.
  10. The Event Organisers reserves the right to update, modify or change these Terms and Conditions from time to time. Any changes will be available on the Rockynats website.

Voluntary Assumption of Risk

WARNING - MOTOR RACING EVENTS AND MOTOR SPORTS ACTIVITIES ARE INHERENTLY DANGEROUS AND THERE IS SIGNIFICANT RISK OF INJURY, DISABILITY OR DEATH (INCLUDING AS AN SPECTATOR). PLEASE NOTE THAT BY ATTENDING THE EVENT YOU MAY BE EXPOSED TO SUCH RISK AND YOU ATTEND THE EVENT AT YOUR OWN RISK

  1. By attending or participating in the Event, you agree to release the Event Organisers, sanctioning body, promoters, sponsor organisations, land owners and lessees, organisers of the Event, their respective servants, officials, representatives and agents (collectively, the “Associated Entities”) from all liability for death, personal injury (including burns), psychological trauma, loss or damage (including property damage) (“harm”) howsoever arising from your participation in or attendance at the Event, except to the extent prohibited by law.  
  2. You agree that the Associated Entities do not make any warranty, implied or express, that the Event services will be provided with due care and skill or that any materials provided in connection with the services will be fit for the purpose for which they are supplied, and you agree to attend or participate in the Event at your own risk.  
  3. You acknowledge that the risks associated with attending or participating in the Event include but are NOT LIMITED to the risk that you may suffer harm as a result of:  
    1. motor vehicles (or parts of them) colliding with other motor vehicles, persons or property;  
    2. high levels of noise exposure;
    3. acts of violence and other harmful acts (whether intentional or inadvertent) committed by persons attending or participating in the Event; and
    4. the failure or unsuitability of facilities (including grand-stands, fences and guard rails) to ensure the safety of persons or property at the Event.
  4. You agree that motorsport is dangerous and that accidents causing harm can and do happen and may happen to you. You accept the conditions of, and acknowledge the risks arising from, attending or participating in the Event.
  5. You agree, accept and acknowledge that you or your invitees will be liable for your own loss or damage suffered by you or your invitees at the Event.
